Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hi-Jack (the "Service"), operated by Tinker Apps Inc. ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

1. Eligibility and Accounts

You must provide accurate information when creating an account. You are responsible for activity that occurs under your account. Hi-Jack's primary audience is teenagers and young adults; if you are under the age required by your local law to use the Service without parental consent, you should use it only with a parent or guardian's involvement. Creating an account requires verifying a phone number you control via a one-time SMS code; message and data rates from your carrier may apply.

2. The Service

Hi-Jack lets friends send each other a photo (a "Hi-Jack") as a playful challenge. The recipient can accept or decline; accepting starts an optional time-limited challenge and, if the recipient chooses, hands off to a device Shortcut so they can set the photo as their Lock Screen. Only approved friends can send you a Hi-Jack, and you control whether an accepted Hi-Jack becomes visible to anyone else.

3. User Content

You retain ownership of the content you submit, upload, or send through the Service ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, display, and use User Content as reasonably necessary to operate, improve, and provide the Service.

You represent that you have the rights needed to submit your User Content and that your User Content does not violate any law or the rights of others.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, fraudulent, or abusive purposes.
• Upload content that infringes intellectual property, privacy, or other rights.
• Post or send defamatory, harassing, threatening, hateful, or sexually explicit content.
• Impersonate another person, or send Hi-Jacks to people who haven't agreed to be your friend.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service.
• Reverse engineer or misuse the Service except as allowed by applicable law.

5. Blocking and Reporting

Hi-Jack lets you block or report another user, or a specific Hi-Jack, at any time. Reports are reviewed by us and are never shared with the person you reported. Blocking immediately and mutually cuts off friending, sending Hi-Jacks, and seeing each other's content. We may suspend or remove an account based on a report or our own review, at our discretion.

6. No Guarantee of Wallpaper Changes

Hi-Jack's Lock Screen hand-off works through Apple's public Shortcuts app, which requires a one-time setup you control and which Apple does not let any app verify the result of. We cannot confirm, and do not claim, that accepting a Hi-Jack actually changed your device's wallpaper — only that you completed the in-app steps. A manual fallback (saving the image so you can set it yourself) is always available.

7. Intellectual Property

The Service, including our branding, software, designs, and underlying technology, is owned by Tinker Apps Inc. or its licensors and is protected by applicable intellectual property laws.

8. Termination

We may suspend or terminate access to the Service if you violate these Terms, create risk for us or others, or where necessary for legal or operational reasons. You may stop using the Service, or delete your account, at any time.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, or that the Service will meet every expectation or requirement.

10. Limitation of Liability

To the fullest extent permitted by law, Tinker Apps Inc. and its directors, officers, employees, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity arising from or related to the Service.

11. Indemnity

You agree to indemnify and hold harmless Tinker Apps Inc. from claims, liabilities, damages, losses, and expenses arising out of your User Content, your misuse of the Service, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Manitoba and the applicable laws of Canada, without regard to conflict of law rules, unless applicable law requires otherwise.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
